Extended Producer Responsibility for Online Marketplaces

On November 6, 2024, the Italian Parliament approved a significant legislative measure aimed at simplifying administrative procedures for all entities selling products subject to the Extended Producer Responsibility (EPR) regime through e-commerce platforms. This measure is part of the amendments to Legislative Decree No. 131 of September 16, 2024, also known as the “Salva Infrazioni” Decree.

The amendment introduces, under Article 14-ter, an innovative system called “pay on behalf.” This system streamlines the collection of declarations for placed-on-the-market data and the environmental contributions owed by sellers operating on marketplaces. It offers a practical tool to help small and medium-sized enterprises (SMEs) fulfill their regulatory obligations while actively contributing to the end-of-life management of their products.

This system allows e-commerce platforms to collect data and contributions on behalf of third-party sellers using their channels to market one or more types of products covered by the EPR regime (e.g., batteries, electrical and electronic equipment, and finished textile products).

A concrete step towards simplification

The measure represents the evolution and institutionalization of a pilot project developed between 2022 and 2023 by the Ministry of the Environment and Energy Security, Erion Energy and Amazon Italy. With the introduction of “pay on behalf,” SMEs can focus on their core business activities while delegating bureaucratic formalities to online platforms.

This approach not only reduces the administrative burden for sellers but also promotes more responsible and sustainable management, contributing to the transition towards a circular economy.
